These general terms and conditions of sale apply to all orders placed through the website www.tobeArt.com.
PRODUCT INFORMATION
The products presented are available within the limits of our stocks and for some, not stocked by Frederic Dorbes, within the limit of their availability from our suppliers.
The site presents the essential characteristics of the products offered, in particular the name, components, dimensions, and sales price in euros.
The photographs reproduced on the site illustrating the products are indicative and do not fall within the contractual field. Consequently, Frederic Dorbes cannot be held liable in the event of an error in any of these photographs.

PRICE
Prices are indicated on our site in Euros, including all taxes, excluding participation in processing and shipping costs.
These delivery costs are calculated based on the amount of the order, its destination, and the shipping method chosen by the customer.
The prices indicated can be modified at any time without notice, it being understood that the items will be invoiced on the basis in force at the time the order is recorded.
For any delivery outside Metropolitan France, any customs duties or local taxes remain the responsibility of the recipient.
All orders, regardless of their origin, are invoiced and payable in Euros only.
The products remain the property of Dorbes-tobeArt until full payment of the price, regardless of the date of delivery of the product.
DELIVERY
Books are delivered to the delivery address indicated by the customer during the order, who undertakes to receive the products ordered.
Frederic Dorbes cannot be held responsible for damages, losses, or other problems caused to the goods during transport.
Delivery can only take place once the order has been validated by the customer and, unless otherwise provided in the order form, payment has been made. The bank payment centers concerned must therefore have given their prior agreement for payment. In the event of refusal by said centers, the order will be automatically cancelled.
The average timeframe is 2/4 days for France, but it does not constitute a strict deadline and in the event of late delivery, Frederic Dorbes' liability cannot be engaged.
Regarding deliveries outside of metropolitan France, the ordered books are imported into the destination country by and under the responsibility of the customer.
QUALITY ASSURANCE
If the item is not suitable, for whatever reason, you can return it to us within ten days of receiving your package (imperatively in its original packaging), in perfect condition, accompanied by the corresponding invoice.
Products damaged, harmed or soiled by the customer are not taken back.
In the event of exercising the right of withdrawal, you will have the choice of requesting either a refund or an exchange of the product, with the exception of shipping and return costs which remain the responsibility of the customer.

Frederic Dorbes treats all information regarding his clientele with the strictest confidentiality and will always be very attentive to protecting all the information you transmit to us.
During your purchases, we only ask for indispensable information (last name, first name, address, e-mail) for quality processing and careful monitoring of your order.
In accordance with the "Informatique et Libertés" law of January 6, 1978, the customer has a right of access and rectification of data concerning them. To exercise this right, simply send a letter by post to our Customer Service.
Out of respect for individual freedom, Frederic Dorbes has chosen not to record cookies.
LIABILITY
Frederic Dorbes is not responsible for the content of the works and cannot be held liable towards the buyer.
The works offered comply with current French legislation.
Books travel under the responsibility of the customer. Dorbes-tobeArt cannot be held responsible for damages, losses or other problems caused to the goods during transport.
Frederic Dorbes declines all responsibility if the delivered item does not comply with the legislation of the delivery country (censorship, prohibition of a title, an artist or author).
Frederic Dorbes disclaims all liability in the event of non-performance of the contract due to a case of force majeure (war, riot, insurrection, interruption of transport, import or export problem, strike, flood, fire...).
Frederic Dorbes disclaims all liability regarding the content of sites to which hypertext links may refer from his own site.
CUSTOMER ACCEPTANCE
These general terms and conditions of sale as well as the prices are expressly approved and accepted by the Buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, their own general terms and conditions of purchase, the act of purchase entails acceptance of these general terms and conditions of sale.
APPLICABLE LAW FOR CUSTOMER RELATIONS
The contract is subject to French law. Disputes will fall under the jurisdiction of the CERGY-PONTOISE court.
